
Candidate Terms And Conditions ​
These are the business terms and conditions between Superyacht Careers LTD and the candidate.

INTERPRETATION;

If not otherwise stated, words imparting the singular number shall include the plural and vice-versa and the masculine shall include the feminine and vice versa.

The headings contained in these terms are for convenience only and do not affect their interpretation.

DEFINITIONS

In these terms the following definitions apply;

“Data protection Laws” means the data protection act 2018, the general data protection regulation (EU 2016/679) and any applicable statutory or regulatory provisions in force from time to time relating to the protection and transfer of personal data;

“Engagement” means the employment of the candidate by the client or the employment of the candidate by any third party who was introduced to the candidate by the client. In the interest of clarification, this includes any type of contract type (permanent, temporary ect).

“Introduction” refers to when;
-
the agency sends the client the curriculum vitae, portfolio or other contact information of the candidate.

the client interviews the candidate by ANY means after being presented with the candidate’s information by the agency.

“Losses” refers to damages, travel expenses, fines or penalties, legal costs or fees expenses, fines, penalties or interest, whether direct, indirect, special or consequential (including, without limitation, any economic loss or other loss of profits, business or goodwill, time and reasonable legal fees) and changes, including such items arising out of or resulting from actions, proceedings, claims and demands.

THE PARTIES;

“The Agency”, refers to Superyacht careers (registered company number 13962256 of address 11 South Western House, Canute Road, Southampton, SO14 3DW.

“The Client” refers to the vessel or person to whom the candidate is presented for an engagement. In order to prevent doubt this term includes any subsidiaries, associated persons/crew, corporate entities, and support vessels.

“The Candidate”, Refers to the person/persons who are presented to the client by the agency for an engagement.

“Third Parties”, refers to any party who is not named above (defined in clauses 3.1, 3.2, 3.3).

GENERAL;

These terms and conditions constitute the agreement between the agency and the candidate for the introduction to a client and so shall prevail over any and all other terms of business put forward by the candidate.

For the avoidance of doubt, all applications and documents submitted are submitted to the agency and not directly to any client in conjunction with the Employment Agencies Act 1973. The agency will represent both of the other parties (the candidate and the client) until an introduction is arranged.

The Agency acts as an employment agency and purely as a means of introduction between the candidate and client, as described in section 13 (2) of “The Employment Agency Act 1973) therefore has no responsibility for any travel arrangements or agreements or contracts made between the client and candidate after the introduction.

THE AGREEMENT;

By clicking to agree to these terms and conditions the candidate permits the agency to;

Share the candidates personal information with the clients.

to store the candidates personal information within the data protection laws.

Share the candidates personal information with third parties whom the agency may in the future sell, transfer, or merge parts of our business or our assets and duties under these terms to any party at any time.

The candidate agrees;
-
to inform the agency immediately by written means after an engagement/employment offer is made by the client or third party.

to take full responsibility for provided up to date information’s on ALL documents and information they provide.

that the agency shall not be liable under any circumstances for any losses whether direct, indirect or consequential.

not to share or disclose any of the agency’s methods, materials or data to any third party without written consent by the agency.

The candidate may not transfer or assign any of their rights and duties under these terms without the prior written consent of the agency.

The candidate acknowledges that the agency will not provide any personal information of the candidate to any friend or relative of the candidate unless previously agreed, in writing as an emergency contact.

Any complaints against the agency are to be submitted in writing and will be subject to an investigation and documented in order to resolve any issues.

Any complaints against the Client that violates the Maritime Labour Convention, the agency will report this to the relevant authority/flag state as per the Maritime Labour Convention.

Any and all updates to these terms and conditions will be informed to the candidate by the agency via email. These terms and conditions were updated on the 8th June 2023.

If the candidate wishes to delete their account or information, they must submit this request to the agency in writing, at which point the agency will comply.

The agency will not charge any fee’s to the candidate for job seeking services in compliance with the Employment Agencies Act 1973.

If you do not agree to these terms we are unable to proceed.
